Wrap: The State Supreme Court appointed Circuit Judge Richard Bresnahan to a case against Montgomery County prosecutor Lee Elliott.

Elliott is accused of representing a defendent in a misdemeanor traffic case.

Missouri law bans a prosecutor from representing anyone other than the state in criminal cases.

Attorney General Chris Koster filed court documents to remove Elliott from office last week.

Elliott is temporarily barred from handling cases until a decison can be made about whether or not he should be removed from office.

Wrap: St. Louis County Circuit Judge Richard Bresnahan will hear the case against Montogmery County prosecutor Lee Elliott.

Elliott is accused of defending a man facing a misdemeanor speeding charge.

It is illegal for a prosecutor to represent anyone but the state in criminal cases under Missouri law.

Attorney General Chris Koster filed court documents against Elliott last week.

Elliot was suspended from his duties soon after.

He will remain suspended until a decision is made about whether he should be removed from office.
