The amendment makes it illegal for judges to take into account home schooling in determining custody.

The amendment also keeps judges from forcing the custodial parent to move children from a home school to a public or private school.

This allows parents with custody to decide what's best for the child.

Representative Tim Harlan opposed the amendment calling it restrictive.

The amendment is tacked onto a bill dealing with children and divorce that's up for first round approval in the House.
